Bama Appliance Equipmemt Rental Contract
This Equipment Rental Agreement ("Agreement") is made on the ___ date entered below between Bama Appliance, as a business located in Decatur Alabama, hereinafter referred to as the "Lessor," and Customer residing at address entered below, hereinafter referred to as the "Lessee."1. Description of EquipmentThe Lessor hereby rents to the Lessee the following equipment:
Equipment: Washer and Dryer Set
Quantity: One set (1 washer, 1 dryer)
Condition: New
Serial Numbers: Pictures taken at delivery
The equipment will be delivered, installed, and picked up at no additional cost to the Lessee by Bama Appliance, the Lessor.2. Rental Term and PaymentMinimum Rental Term: 6 months
Monthly Rental Fee: $100.00
Promotional First Month Fee: $50.00 (due upon delivery)
Due Date: Monthly payments are due on the anniversary of the equipment's delivery date.
The Lessee agrees to make all payments to Bama Appliance via Stripe Invoice sent electronically.3. Security DepositNo security deposit is required under this Agreement. The Lessee acknowledges that they are liable for any damage beyond normal wear and tear.4. Delivery TermsBama Appliance provides free delivery, installation, and pickup. The Lessor will be responsible for transporting the equipment at the start and end of the rental period. No additional delivery fees will be charged.5. Equipment Usage GuidelinesThe Lessee agrees to:
Use the washer and dryer set only for personal, household purposes.
Operate the equipment according to the provided instructions. Notify Bama Appliance immediately of any malfunction.The Lessee must not:
Use the equipment for commercial purposes. Overload the machines or use inappropriate detergents.
Attempt to repair the equipment without prior authorization from Bama Appliance.6. Repair and MaintenanceBama Appliance will provide free repairs and maintenance for issues caused by normal wear and tear.The Lessee will be held responsible for any damage caused by improper usage, including but not limited to:Overloading:
Using non-compatible detergents.Negligence or misuse:
If the equipment is damaged due to improper usage, the Lessee may be required to pay repair or replacement costs.7. Late Payments and Late ChargesIf the Lessee fails to make a payment on time:
Bama Appliance may terminate the Agreement, and repossess the equipment. The Lessee may incur late fees of $10.00 per day for each day a payment is late.8. Rental TerminationThe Lessee must rent the equipment for a minimum term of 6 months. After the initial term, the Agreement will continue on a month-to-month basis. Either party may terminate the Agreement with at least a 10 day written notice.Upon termination, the Lessee must:
Return the equipment in good condition, accounting for normal wear and tear. Allow Bama Appliance to pick up the equipment at a mutually agreed time, within 10 days of rental termination.9. Loss, Damage, and LiabilityThe Lessee is liable for any loss or damage to the equipment while in their possession. If the equipment is lost or damaged beyond repair due to the Lessee’s actions, the Lessee will compensate Bama Appliance for the fair market value of the equipment. Fair market minimum $400 for the set.10. Ownership RightsThe Lessee acknowledges that the rented washer and dryer set is the sole property of Bama Appliance.The Lessee will never acquire ownership rights to the equipment, regardless of the number of payments made.
The Lessee is not permitted to sell, transfer, or encumber the equipment.11. Indemnity ClauseThe Lessee agrees to indemnify and hold harmless Bama Appliance, from any claims, damages, or injuries caused by the misuse or improper handling of the equipment during the rental period.12. Condition ChecklistUpon delivery, the Lessor and Lessee will inspect the condition of the equipment and immediately notify Bama Appliance of any damages or flaws. The Lessee must return the equipment in substantially the same condition, accounting for normal wear and tear.13. InsuranceBama Appliance does not require the Lessee to purchase insurance. The Lessee is responsible for any loss or damage to the equipment while in their possession.14. Parties’ SignaturesParties agree to the terms of this Agreement and confirm their understanding by submitting completed form below.
